Therapy Effect Consulting ("we", "us", "our") is committed to protecting the privacy and confidentiality of everyone who uses our website and services. This policy explains how we handle your personal data in accordance with the Data Protection Act, 2019 of Kenya and its regulations.
Information we collect
- Contact details such as your name, email address and phone number when you book a session, register for an event, buy a resource, complete an assessment or contact us.
- Session and wellbeing information that you choose to share with us, such as the service you need, your preferred session type and any message you send. Assessment answers and results are treated as sensitive personal data.
- Payment information for resource purchases. Payments are processed by our payment provider; we do not store your card or mobile money PIN details.
- Technical information such as your IP address, browser type and pages visited, collected through cookies and analytics tools to help us improve the website.
How we use your information
- To schedule, confirm, remind you about and deliver therapy sessions.
- To respond to your enquiries and follow up where you have asked us to contact you.
- To process event registrations and resource purchases, and deliver what you have requested.
- To send you updates about events and resources, only where you have opted in. You can opt out at any time.
- To keep our website secure and understand how it is used.
Legal basis and consent
We process your personal data on the basis of your consent, to take steps towards or perform a service you have requested, and to meet our legal and professional obligations. Where we process sensitive personal data, such as health information, we do so only with your explicit consent and with additional safeguards.
Confidentiality
Everything you share with our therapists is held in strict confidence in line with professional ethical standards. Confidentiality may only be broken where required by law or where there is a serious risk of harm to you or others.
Sharing your information
We do not sell your personal data. We only share it with:
- Service providers who help us run our services, such as email delivery, calendar scheduling (Google) and payment processing, under appropriate data protection terms.
- Authorities, where we are required to do so by law.
Some of these providers may store data outside Kenya. Where this happens, we make sure appropriate safeguards are in place as required by the Act.
How long we keep your information
We keep personal data only for as long as needed for the purposes described above, or as required by law and professional record-keeping rules, after which it is securely deleted or anonymised.
Your rights
Under the Data Protection Act, 2019 you have the right to:
- Be informed of how your personal data is used.
- Access the personal data we hold about you.
- Object to the processing of all or part of your personal data.
- Request correction of false or misleading data.
- Request deletion of false, misleading or unnecessary data.
- Withdraw your consent at any time.
You may also lodge a complaint with the Office of the Data Protection Commissioner (ODPC) if you believe your data has been mishandled.
